Terms of Service

These Terms govern your use of Aria ("Aria", "we", "us"), software based in Dubai, United Arab Emirates. By creating an account or connecting a WhatsApp Business account, you agree to these Terms.

1. The service

Aria is a third-party software service that lets a real-estate broker or business connect and manage their own WhatsApp Business account to build a CRM from their conversations through the official WhatsApp Business Platform (Cloud API). The WhatsApp history sync itself is read-only; outbound messages are sent only through features you explicitly initiate or approve (for example approved campaign templates sent from your own business number), and contact opt-outs are honoured automatically. Aria is not a WhatsApp or Meta product.

AI-generated replies ("Aria replies as me"). Aria includes an optional feature that lets Aria answer clients on your behalf. It is off by default. If you turn it on — for a specific conversation, or as your default for conversations — Aria may send AI-generated free-form replies from your own WhatsApp Business number, in your name, but only inside WhatsApp's 24-hour customer-service window (i.e. after the client has messaged you). You can switch it off per conversation or globally at any time; opt-out ("STOP") requests are always honoured. Outside that window, an approved template message remains the only way to message a client first, and campaigns always require your explicit approval. You remain responsible for messages sent from your number, including AI-generated ones, and should review Aria's replies and correct anything that is wrong.

2. Eligibility

You must be at least 18 and use Aria for a legitimate real-estate business. You are responsible for the accuracy of the account information you provide.

3. Your WhatsApp Business account and authorisation

When you connect your WhatsApp Business account, you authorise Aria to access and process that account's data to build and maintain your CRM. The history sync is read-only; nothing is sent to your contacts unless you explicitly initiate or approve it, and opt-out ("STOP") requests are suppressed from future sends automatically. You confirm you are entitled to grant this authorisation. You are responsible for the accuracy of your WhatsApp Business profile, for messaging your contacts lawfully, and for honouring opt-out and block requests.

You must not use Aria to send spam or unsolicited bulk messages, to import non-consented contact lists, to impersonate others, to message in prohibited industries or with prohibited content, or in any way that violates the WhatsApp Business Messaging Policy or applicable law.

6. Acceptable use, reverse engineering and confidentiality

6.1 Automated access. You may use Aria (in this clause, "the Service") only through the interfaces we provide (the web app, the desktop app, the connected WhatsApp number and any documented API). You must not scrape, crawl, spider or harvest the Service or its content; use bots, scripts, headless browsers or other automated means to access, monitor, copy or bulk-export any part of the Service or its data; or circumvent any rate limit, access control, tenant boundary or usage cap. Exporting your own client data through the export features we provide is always permitted.

6.2 Reverse engineering. You must not reverse engineer, decompile, disassemble, decode or otherwise attempt to derive the source code, architecture, prompts, system instructions, agent behaviours, models, model weights, fine-tuning data, evaluation methods or data pipelines of the Service, or probe, scan or test the Service for vulnerabilities other than through a written security-testing agreement with us. Attempting to extract Aria's or any team member's instructions through conversation ("prompt extraction") is a breach of this clause.

6.3 Competing products and model training. You must not use the Service, its outputs, its documents or its data to build, train, benchmark, improve or market a product or service that competes with Aria; use any part of the Service to train, fine-tune or evaluate a machine-learning model; or resell, sublicense, rent, white-label or otherwise make the Service available to third parties without our written agreement.

6.4 Access and credentials. Your login, device tokens and workspace are for you and the users we have authorised on your account. You must not share credentials, allow anyone else to use your seat, or connect a WhatsApp number that you are not entitled to operate. You are responsible for all activity under your account.

6.5 Our confidential information. The non-public parts of the Service are confidential and proprietary to Aria, including our methods, prompts, system and agent instructions, agent behaviours and deliberation between agents, analysis engines and scoring methods (including the "Money Test", price opinions and yield forecasts), training and testing recipes, templates, documents, data compilations, pricing not published on our website, roadmap and anything marked or reasonably understood to be confidential. You will keep it confidential, use it only to use the Service as intended, and not disclose it to anyone outside your business who does not need it. This does not cover information that is public through no fault of yours, that you already lawfully held, or that you are required by law to disclose (in which case you tell us first where you lawfully can).

6.6 Ownership. As between you and us, you own your client data, your conversations, your notes, your uploaded documents and your training brief, and you grant us only the licence needed to run the Service for you as described in our Privacy Policy. Aria owns all intellectual property in the Service, its software, prompts, agents, models, engines, designs, documents, compilations, and all improvements to them, however arising. Nothing in these Terms transfers any of that to you; you receive a limited, non-exclusive, non-transferable right to use the Service for your real-estate business while your subscription is active and you comply with these Terms.

6.7 Feedback. If you send us ideas, suggestions or feedback about the Service, we may use them without restriction or payment, and you grant us a perpetual, irrevocable, worldwide, royalty-free licence to do so. We will never identify you as the source without your permission.

6.8 Enforcement. Breach of this clause is a material breach. We may suspend or terminate access immediately, remove content, and seek injunctive relief and damages, in addition to any other remedy. This clause survives termination of your account.

7. Fees and billing

Aria is a paid subscription; current plans and prices are published on our pricing page or agreed with you in a separate order. Subscriptions renew automatically each billing period until cancelled. Payments are processed by a licensed third-party payment provider; we do not store your card details. You may cancel at any time, which stops future renewals — fees already paid are non-refundable except where the law requires otherwise. Prices exclude VAT, which is added where applicable. Founders pricing remains available for as long as the relevant subscription stays continuously active. WhatsApp Business Platform messaging charges set by Meta, where applicable, are your responsibility.

8. WhatsApp and Meta are not parties

WhatsApp and Meta are not parties to these Terms and provide no warranties in respect of Aria. WhatsApp is a trademark of Meta Platforms, Inc.; Aria is not affiliated with, endorsed by, or sponsored by WhatsApp or Meta.

9. Disclaimers and limitation of liability

Aria is provided "as is" without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Aria will not be liable for indirect, incidental or consequential damages, and our total liability is limited to the fees you paid in the 12 months before the claim.

10. Suspension and termination

You may stop using Aria and disconnect your account at any time. We may suspend or terminate access for breach of these Terms or the Acceptable Use Policy, or where required to protect the service or comply with Meta's policies. On termination we delete your data as described in our Privacy Policy and Data Deletion page.

11. Governing law

These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and the courts of Dubai have jurisdiction.
